Purescapes Booking Terms & Conditions

1. Booking, Confirmation and Payment

(a) In order to secure a booking for our services (“the Retreat”) you (the “Client” or “Clients”) must request a date and pay a 30% none refundable deposit of the Retreat price; in the case of bookings made within twelve weeks of departure, 100% of the Retreat price shall be payable by the client.

(b) Pure Scapes Retreats Ltd. [“Purescapes”] will then send you a written confirmation of the booking so as to establish a binding contract between Purescapes and the Client, which will be governed by the laws of Ontario, Canada, and subject to the exclusive jurisdiction of the courts of Ontario, Canada.

(c) As noted above, the balance of the price of the Retreat must be paid not later than four (12) weeks prior to departure and if not received on time we reserve the right to treat the booking as cancelled by you and to levy cancellation charges as set out below.

2. Alterations by you

Note: Purescapes Lanzarote Cycling Retreat: No changes are permitted except to transfer your booking to another  party if you are not able to attend the September 5, 2022 retreat.

Other Purescapes Retreats, If, after we have confirmed a booking, you request a change in the dates or location of your Retreat we will do our best to meet your revised requirements and reserve the right to charge an alteration fee of 2% of the Retreat price but any such requests received within eight weeks before departure may be treated as a cancellation by you and re-booking and thus subject to cancellation charges.

3. Cancellation by you

(a) Cancellations by you must be in writing to us and will be effective on the day we receive them. Recorded delivery is recommended but we will accept electronic mail (“email”) messages, if signed and sent by the signatory to the booking form. While electronic signatures are preferred on email messages, we will accept emails without electronic signatures.

(b) A deposit is due on reserving your Retreat date and the balance shall be due four (12) weeks prior to starting your Retreat.

The penalties for cancellation depend on how much notice you give:

Twelve (12) weeks or more prior to your scheduled Retreat – Pure Retreats will keep the Deposit only.
Less than twelve (12) and up to four (8) weeks prior to Retreat date – the penalty is 75% of price of the Retreat.
Less than eight (8) weeks prior to Retreat date – the penalty is 100% of the Retreat price.

(c) Purescapes cannot give any allowance or refund for meals, accommodation, activities, etc., not taken during the Retreat when these are included in the Retreat price.

(d) Once the Retreat has started, Purescapes will not give any refunds for cancelling part of the Retreat.

(e) If your reason for cancelling is because of events beyond your control (e.g., illness, death of a close relative etc.) you may transfer your booking to another party provided that you give us reasonable notice to make such arrangements and that you and the transferee agree to be jointly and severally liable for any outstanding payment under the contract.

4. Alterations or Cancellation by Us

Once a client’s booking has been confirmed Purescapes will make every effort to provide the Client with the booked Retreat arrangements but reserve the right to alter or cancel the whole or part of the Retreat if we cannot avoid doing so. Reasons for doing so would include such matters as extreme adverse local weather conditions, natural disasters, pandemics, civil strikes or war, terrorist activity, fire, drought conditions, mass power outages and any similar events [“Force Majeure”]. If any such alterations are significant then we reserve the right to cancel the Retreat and we will refund all monies paid to Purescapes.

Purescapes reserves the right in any circumstances to cancel your Retreat, in which case we will offer a refund in full of all monies paid. In particular our Retreats require a minimum number of at least 50% of the participants to have booked by twelve (12) weeks before departure. If this minimum number is not reached by that date we may cancel and refund the money to you.

In no case will we cancel your holiday less than three (4) weeks before the scheduled departure date, except for reasons of Force Majeure, or failure of the Client to pay the final balance. If a cancellation occurs within four (4) weeks of departure for reasons other than Force Majeure, compensation will be payable according to Section 3.

5. Prices and Increases

(a) Unless otherwise agreed the Retreat price includes scheduled local transfers to/from the local airport, accommodation, services of professional trainers and guides, all activities, a massage, and scheduled meals.

(b) Not included in the Retreat price are any and all flights, travel insurance, tipping for services, non-scheduled transfers, and items of a personal nature.

(c) The Retreat price is based on costs known at the date of the booking and on relevant rates as at that date and is subject to variation only to reflect subsequent increases in local transportation costs, dues, taxes and fees chargeable for adverse exchange rate variations. Even so we will absorb any such price increases up to an equivalent of 2% of the Retreat price but if the necessary price increases exceed that level then we will notify you accordingly and reserve the right to charge you that extra amount up to a maximum of 10% at which level you will have the right to cancel the Retreat within 14 days of such notification with full refund of all monies paid or we will have the right to charge you such excess over 10% of the Retreat price. Notwithstanding the provisions of this clause the Retreat price will not be increased within four (4) weeks of departure

6. Our Responsibilities

(a) Purescapes accepts responsibility for ensuring that the Retreat that you book with us is supplied as described and that the services we are contractually obliged to provide are to a reasonable standard. We accept responsibility for the acts and/or omissions of our employees, agents and suppliers except where they lead to death, injury or illness (see Limitation of Liability at clause 11 below).

(b) Optional trips booked locally are not our responsibility.

7. Your Responsibilities

(a) It is your responsibility that passports (with at least 6 months validity beyond the date of your return), visas, inoculation certificates and other necessary travel documents are in order and we reserve the right to charge you any costs incurred by us due to your failure in any of these respects. It is also your responsibility to check in for your flights by the correct time and to be in the right place at the right time for ground travel arrangements. We do not accept liability if you fail to do so and no credits or refunds will be given for lost or mislaid air tickets or other travel documents.

(b) It is a condition of your contract with us that you act with reasonable care while on Retreat and that you comply with all health and safety requirements as dictated by the circumstances.

(c) As between you and suppliers of transport and other services which form part of your Retreat, the conditions of business of other suppliers will apply which may mean that you will be required by such suppliers to sign liability waivers or other documentation for some potentially more hazardous activities such as cycling, sailing, sea cruises and hiking.

(d) There are risks inherent with any activity Retreat and with physical exercise such as cycling, yoga, swimming, hiking and the other activities on your itinerary. As such, we strongly recommend that you consult your doctor before travel to advise on your ability to undertake strenuous exercise. You should make your physician and us aware of any medical condition which may affect your ability and comfort when undergoing vigorous exercise during the Retreat.

8. Insurance

It is a binding condition that you have appropriate travel insurance. As well, you must have personal liability, personal accident, medical expense and cancellation insurance at the time of booking your Retreat.

You need to have your own travel insurance and provide us with those details in case of an emergency. As noted above, you should also check with your doctor that you are sufficiently fit and healthy to undertake any physical activity we have arranged. If you experience any injury or discomfort during any activity organised for you, then you must immediately stop that activity and consult a member of the Retreat staff.

9. Eligibility

We require that Clients be at least 18 years of age on all Retreats.

10. Risks

Purescapes retreats will take Clients to places where facilities, infrastructure, and safety and other standards may not be sophisticated and may be different from those in a Client’s home country. Retreats involve physical activity that can be demanding, depending on the condition of the Client, and the risk of serious personal injury, including permanent disability and death from accident, illness or the actions or negligence of other persons. Medical facilities and services may not be easily accessible and may not be sophisticated.

11. Limitation of Liability, Release and Indemnity

To be eligible to attend a Retreat, Clients must accept these risks and assume full responsibility for any loss, injury, death or damage to them, their family or their dependents arising in connection with their participation, or the participation of their family, in the Retreat.

While Purescapes provides most of the travel services, some services may be provided by local independent suppliers who are subject to the laws of the place where the services are provided, and any conditions imposed by those suppliers. The liability of the independent suppliers may be limited by their tariffs, conditions of carriage, tickets and vouchers, and international conventions and agreements.

The price of all Purescapes services is based on Clients agreeing to this Limitation of Liability, Release and Indemnity. In consideration for participating in the trips, Clients agree not to claim against Purescapes in respect of, and forever release them from, all liability for economic loss and physical or mental injury, direct or indirect, arising in connection with the Retreat – including, without limitation, permanent disability and death; any emotional distress; any loss of services, financial support, aid, consortium or companionship; and any damage to or loss of property – in each case even if caused in whole or in part by the conduct, including the negligence, of Purescapes, except where such loss, injury or damage is caused by reckless or fraudulent conduct on the part of Purescapes, or its employees, guides, shareholders, officers or directors, in which case the Client retains the right to only make a claim against Purescapes in respect of that conduct.

Clients further agree that they will indemnify and hold Purescapes harmless in respect of any claims arising in connection with the trip made by: i) third parties, which arise from the misconduct of the Clients; ii) the Client’s family members, dependents or heirs, iii) third parties, which the Client, their estate, their family members, dependents or heirs have sued, if damages are recovered from such third parties, to the extent the third party obtains any indemnification from Purescapes; except where the loss, injury, death or damage is caused by the reckless or fraudulent conduct on the part of Purescapes, or their employees, guides, shareholders, officers or directors.

Purescapes reserves the right to decline accepting or retaining any Client whose health or actions in the sole judgement of Purescapes impedes the operation of a Retreat or the welfare or enjoyment of fellow Clients. In further consideration for participating in the Retreat, Clients agree that Purescapes or their designate, may use any social media posts, photographic or film records of the trips for promotional and/or commercial purposes, without any remuneration to the Client. The Client agrees to assign all right, title and interest they may have in or to any media in which their name or likeness might be used to Purescapes.

This Limitation of Liability, Release and Indemnity is binding upon all members of the Client’s family, dependents, estate, heirs, successors and legal personal representatives. Any claim or dispute arising out of or relating to these terms and conditions or their interpretation or the Retreat will be resolved exclusively in the courts of the Province of Ontario, Canada, and will be governed exclusively by Ontario law.

12. Modifications

Purescapes reserves the right, in its sole discretion, to add to, remove, modify or otherwise change any part of these Terms and Conditions, in whole or in part, at any time. Further, Purescapes reserves the right to change, modify, suspend or discontinue any aspect of the Purescapes Site, Services or Content from time to time without notice or liability and for any reason whatsoever.
